morning. it is unclear if this attacker knew it would impact his family. he did admit to not carrying out this attack until his daughter graduated from high school. he has to live with their potential deportation as he sits in jail potentially for the rest of his life. >> i don't think anybody should shed too many tears over this. this is something he and almost certainly his wife planned in advance. they went and applied for visas to come to the united states. within a couple weeks, they filed an asylum claim knowing under biden administration rules they would be allowed to stay here and get work permits and after that work permit expired, he stayed here as a visa overstay. we have more than half a million visa overstays every year and

this guy along with hundreds of thousands of others have exploited our visa system. this is another example of why our immigration enforcement is important, why we need to do a better job of vetting applicants and why it is important for the trump administration to have this mass deportation campaign to try to clean up the mistakes of all the people allowed in under the biden policy and we can't be limiting enforcement to people convicted of crime. that let's people stay here to have the opportunity to commit horrific acts like this. >> carley: do you foresee challenges in deporting his family or will they be back in egypt quickly? >> i don't see how they could have a case for staying here. they have to show they would be

bar baracka. let's remember that alina habba did drop those trespassing charges against baracka. does he have a case, katie? >> katie: i did read his lawsuit, it is very weak. he has challenges on all front. he makes claims that are bivens claims. supreme court has been clear they don't extend those claims in novel context like here. alina habba has prosecutorial immunity. she believed at the time there was violation of the law. in terms of defamation claim, he would have to prove actual malice, meaning she falsely made comments and based upon the facts there were reasonable grounds to think he was in violation of the law to leave

the private facility. >> todd: when alina habba said he was trespassing, does she have prosecutorial immunity for that statement when she says it is a crime and then drops the charges? >> prosecutors have discretion to pursue charges or to drop them. at the time of the arrest, was there probable cause? probable cause is low standard, means there is some evidence that the person committed an offense. it does not indicate in any particular way that there was not probable cause, those are separate elements. i think it is weak across the board believe the mayor said he was looking for an apology. on a legal analysis, i think he runs into insurmountable hurdles on all counts he brought.
